Editorial : CFA ruling may lead to challenges

【明報專訊】IN the Hysan Development appeal case the Court of Final Appeal (CFA) ruled that the Town Planning Board (TPB) should, in setting height restrictions in connection with outline zoning plans, take into account the Basic Law provisions about protecting private property rights and make a proper "proportionality analysis", asking whether a reasonable balance had been struck between the public interest and private property rights. It therefore remitted Hysan's appeal to the TPB.
