【明報專訊】THE COURT OF FINAL APPEAL (CFA) has heard a case in which an American vulture fund seeks to recover HK$800 million from the Democratic Republic of the Congo (DRC). A key question about state immunity has to do with a question of principle about the differences between the Central People's Government (CPG) and the HKSAR government. The CFA has decided to ask that the Standing Committee of the National People's Congress (SCNPC) clarify the meanings of such acts of state as defence and foreign affairs instead of ruling on the case with a view to preventing another constitutional crisis. In our view, this decision is entirely appropriate.
