Editorial:Interpreting the Hong Kong National Security Law

【明報專訊】The Chief Executive (CE) has sought an interpretation of the Hong Kong National Security Law (HKNSL) from the Standing Committee of the National People's Congress (NPCSC). The chairman of the Hong Kong Bar Association (HKBA) pointed out that the interpretation of the law by the NPCSC is based on a mechanism, and it has not much to do with the city's judicial independence. Still, he believed that such power over the interpretation of the law should be exercised with caution as it would inevitably stir up discussions. It is clear that one of the HKNSL's legislative intents is to prevent foreign interference in Hong Kong affairs. Allowing overseas barristers to come to Hong Kong to handle cases that involve charges of collusion with foreign forces is not an appropriate practice. The NPCSC is not exercising its power of legislative interpretation on this matter to replace Hong Kong's judiciary in adjudicating cases, but to improve the establishment of the national security system. A precise interpretation that avoids applying a universal decision across the board can reduce the impact on Hong Kong's judicial tradition.
