Editorial : Contempt of Court undermines the Rule of Law

【明報專訊】THE court hearing the case of criminal contempt of court during the occupation of Mongkok has sentenced Joshua Wong Chi-fung, former convener of Scholarism and Raphael Wong Ho-ming, vice-chairman of League of Social Democrats, to 3 months' and four and a half months' imprisonment respectively. The other 14 defendants have been given suspended sentences. The rule of law is the cornerstone of Hong Kong. It is also a core value which Hong Kong people value most. Contempt of court is a serious criminal offence. One's political beliefs cannot be used as an excuse for violating the law. During the Occupy movement, some learned people who had a legal background told demonstrators that they could ignore the injunction of the court, in effect encouraging demonstrators to treat the court with contempt. The case of contempt of court during the occupation of Mongkok is an important court case that concerns the rule of law. All circumstances for sentencing have been taken fully into consideration by the judge. It is unjustified to claim that it is "political repression". Those who were sentenced to imprisonment should not be "heroised".
