【明報專訊】THE FREE-TV LICENCE ROW has not died down even though the Legislative Council has voted down a motion to invoke the powers and privileges ordinance to acquire the government's papers on the matter. The day before yesterday (November 10), Executive Council (Exco) convener Lam Woon-kwong openly urged Leung Chun-ying to "thoroughly review" as soon as possible the decision-making process. This has led to such wide repercussions that Leung has come under great pressure. As for Lam, he has endeared himself to no hearts for blowing hot and cold on the licence issue.

免費電視發牌風波，並未因為立法會否決引用特權法向政府索取文件的決議案而平息。行政會議召集人林煥光前天公開要求梁振英盡快就發牌過程「深切檢討」，更是一石激起千重浪，梁振英固然備受壓力，林煥光因為在此事取態搖擺，陷身各方不討好的處境。

Lam's comments on the issue have varied from "the decision was made by the Chief Executive" to "a tea-restaurant analogy" and then to "the issue would best be settled by a court of law". And finally, the day before yesterday, he said "the Chief Executive should thoroughly review as soon as possible the decision-making process". Clearly, he has reservations concerning the decision, but in the public's eyes he has been changing his positions all the time. The pro-establishment camp regards Lam's call for a "thorough review" as an attempt to put pressure on Leung and a violation of political ethics, while the public finds Lam's shifting positions difficult to accept. Lam has to pay for this politically.

林煥光就發牌風波，較早前有所謂「特首決定論」、「茶餐廳論」、「由法庭處理最合適」等說法，到前日的「特首應盡快深切檢討發牌過程」，反映他對發牌決定有意見，但是向公衆解說時顯得反覆。「深切檢討論」被建制陣營解讀為對梁振英施壓，有違政治倫理；就公衆接收的信息而言，林煥光歷次說法確有搖擺反覆，因而說服力大打折扣。政治上，林煥光要為此付出代價。

Yet, after the defeat of the powers-and-privileges motion, Lam has simply done what he as Exco convener should have done by asking Leung to thoroughly review the decision-making process so that a lesson may be learned and similar mistakes may not be repeated in future. Indeed, the licence issue has dealt so serious a blow to Exco's credibility that Lam would have failed in his duty if he had dismissed the incident as a mere nothing.

不過，在立會否決了決議案之後，他提出梁振英應該深切檢討發牌過程，以總結經驗教訓，勿再重蹈覆轍，身為行會召集人，這是應有之義；設若林煥光對這樁衝擊行會公信力的大事，以水過不留痕心態看待，反而有未盡職之嫌。

When Leung was himself serving as Exco convener, he often published in newspapers articles voicing opinions different from the government's, for which he was criticised by Donald Tsang Yam-kuen's governing team, and he received an implied reprimand from Tsang for making capital out of his administration. Leung responded by saying that while Exco members had to observe the principle of confidentiality and collective responsibility, they also had the responsibility to participate in discussions on social issues. Seen in this light, Lam's call for a review of the decision-making process certainly meets Leung's criteria. There is nothing wrong with the call as far as government regulations are concerned.

梁振英當年擔任行會召集人時，在報章撰文經常提出與政府不同的觀點，備受曾蔭權班子中人批評，曾蔭權更一度暗諷他「抽水」；梁振英當時回應說行會成員要保密和集體負責，但是也有責任參與社會問題討論。若以此量度林煥光提出檢討發牌過程，應該符合梁振英所說的情况。所以，深切檢討論就相關規定而言，看不到有何不妥之處。

There are leftist papers which once criticised Lam for his political reform proposals. Now, basing themselves on conspiracy theories, they are suggesting that Lam is an undercover agent acting under orders "from some quarters" to "launch a close-range political attack on Leung". It seems they are bent on forcing Lam into stepping down.

一些左派輿論，繼較早前批評林煥光在政改問題的倡議，今次更提出陰謀論，喑指他是「某種勢力」的卧底，「向梁振英發動政治的近身攻擊」，大有要把林煥光逼退之意。

Lam's performance in the post-colonial as well as colonial days has generally been found to be good. The quality of Leung's governing team would suffer without him. Leung should therefore be open-minded enough to bear with Lam. The present composition of Exco and the political style of certain Exco members are such that, without Lam, Exco's decisions would be even less likely to gain public confidence. Politically, Hong Kong is going through the most difficult period since its handover to China. With the government commanding little public respect, there is a special need for people committed to Hong Kong and able to give valuable advice. A man as capable as Lam is a real asset. He should not quit.

林煥光在港英時期和回歸後的表現，獲得普遍肯定，若梁班子少了他，整體質素將會受到影響。所以，梁振英首要需展示胸襟，容得下林煥光。因為以目前行會的組合，以所知部分行會成員的行事作風，少了林煥光，決策的合理性更難以使人有信心。政治上，香港正處於回歸以來最艱難的時刻，政府管治威信低落，需要更多對香港有承擔的人出謀劃策，林煥光這樣的人才肯定可以發揮作用，不應該金盆洗手而去。
