【明報專訊】SOME TIME AGO Asia Television (ATV) wrongly reported that Jiang Zemin was dead. The Legislative Council Panel on Information Technology and Broadcasting had a special meeting to look into the affair as well as allegations that ATV had broadcast "paid news". However, the situation has not cleared up. There are now even more unsolved puzzles.

At the special meeting, Leung Ka-wing, who had resigned as ATV's vice president of news and public affairs, took all the blame for the affair, saying, "I've made a mistake. I've therefore taken the blame for it and resigned." However, he said earlier, "I tried my best but failed to stop the story from being broadcast." He then hinted that he had been pressured into getting it aired. He contradicted himself. Is there any factor he cannot very well mention?

關於誤報江澤民死訊，原任亞視新聞及公共事務高級副總裁梁家榮在特別會議上包攬上身，表示「自己犯了錯誤」，故引咎辭職，與當日他表示「我盡了所有努力，阻不到這單新聞出街」，暗示受壓才播出江澤民死訊，前言不對後語，是有難言之隱？

At the meeting, Mr Leung was asked where the story of Jiang's death had come. He replied, "I wouldn't tell you even if you put a gun to my head." He shielded the "source", saying he had to adhere to the principle that no journalist should name his sources.

The "source" may be an agent of ATV's "backstage boss", convey his orders to its news and other departments and see that they will be followed. If this is the case, the "source" cannot be regarded as a source in the true sense of the word.

We urge that Mr Leung and the person who was his subordinate and had been in touch with the "source" consider the following. It is a sacrosanct principle of journalism that no journalist should name his sources. However, its true purpose is to safeguard the freedom of the press. If the "source" that contacted you is the backstage boss's agent and he told you to broadcast the story of Jiang's death, he, whom you call your "source", is a conveyor of orders and not a source who ought to be shielded. Such a person meddles in journalistic work and violates the freedom of the press. If he is allowed to lurk behind the sacrosanct principle, will not journalism become a joke and the freedom of the press become a joke?

我們籲請梁家榮和曾經與「消息人士」接觸的梁家榮下屬，考慮一種情况。保護消息來源是新聞工作者的神聖原則，其核心精神，是捍衛新聞自由，但是若與你們接觸的消息人士，乃影子老闆代理人，代理人要求你們、命令你們播出江澤民死訊，則這名你們口中的消息人士，根本就是傳令人，而非值得保護的消息人士。因為這樣的人，實質在干預新聞專業、損害新聞自由，現在竟受到神聖原則保護，豈非給業界和新聞自由開玩笑？

What role does Wang Zheng play at ATV? That is another question that was not clarified at the special meeting. According to the information ATV has submitted to the Broadcasting Authority (BA), he is an investor who holds convertible bonds issued by ATV. He is not a shareholder in ATV, nor is he an ATV director or executive. Under the Broadcasting Ordinance, he has no business to control ATV or be involved in its daily management.

當日特別會議，另一個未釐清的情况，就是王征在亞視的角色。根據亞視向廣管局提供的資料，王征是亞視投資者，持有由亞視發出的可換股債券，並非亞視股東、董事或管理層，按廣播條例規定，王征並無身分及權利對亞視行使控制，或參與日常管理。

What has much baffled him is that Wang Zheng, who is not a shareholder in ATV, controls its operation, and ATV people only follow his will.

The BA has said it will look into the role Wang Zheng plays at ATV. The broadcaster is a listed company. It uses the airwaves, which are a public asset. It must abide by the applicable legislation. It has now transpired that its management is quite irregular. The BA is duty-bound to ensure ATV meets all statutory requirements. It must not allow the Broadcasting Ordinance to be toothless to ATV.

廣管局就王征在亞視的角色，已經表示會調查，亞視是公共機構，使用公共資產大氣電波，受法例規管，現在亞視管理被揭發衆多不正常狀况，廣管局有責任確保亞視管理運作，符合法例規定和要求，不能讓廣播條例之於亞視，形同一紙虛文。
