【明報專訊】SO Chun-chau, a street juggler, was arrested when he performed in a pedestrian precinct in Causeway Bay. He was charged with causing an obstruction. Last Wednesday, a magistrate found him not guilty. Street performances may lend a cultural flavour to pedestrian areas where famous outlets exist in large numbers and which are called too commercialised.

Though street performances may add lustre to a community, street performers should not be left to their own devices lest what is supposed to be a good thing should become a nuisance. Suitable control is necessary as well as sensible.

The magistrate who heard So's case said that, though his performance drew a crowd, pedestrian precincts should be full of life and he believed Hong Kong citizens to be so cultural as to accept a certain degree of obstruction. What he said is not at odds with reality. Few would mind street performances causing minor obstructions. Street performers are aware of the need to have regard to the rights of other public place users. Therefore, they have long urged that the government put in place a licensing system as other governments have done. The government has granted their request. It has designated places in open areas outside the Cultural Centre, Sha Tin Town Hall and Kwai Ching Theatre where people may provide pedestrians with free entertainment.

蘇春就案的裁判官指出,雖然表演惹來人群圍觀阻塞街道,但行人專用區應是活潑開朗的地方,相信香港人有足夠文化水平接納這些有限度的阻礙。裁判官的說法未偏離客觀現實,港人普遍不介意因為有藝術表演而令街道有點阻塞,但街頭藝人亦明白必須照顧其他公眾地方使用者的權益,故一直爭取仿效外地,由政府設立發牌制度。政府已順應要求,現正在尖沙嘴文化中心、沙田大會堂露天廣場及葵青劇院的戶外廣場,開放場地供免費街頭表演。

In the long term, the government may consider licensing entertainers to perform in downtown pedestrian precincts and squares packed with jostling crowds as many foreign governments have done. Many local street entertainers are full of praise for Taiwan's experience.

長遠而言,政府可考慮參考外地經驗,在鬧市行人專用區及人流暢旺的廣場空地,發牌予表演藝人,其中台灣的經驗獲得不少本地表演者推崇。

In Taipei there are altogether sixty locations where people may give street performances, including parks, pedestrian precincts and places outside Metro Taipei stations. A person who intends to perform in a place must first hand in his application, which will be considered by a panel comprising performance artists, representatives of the organisation that runs the place and representatives of street performers. Citizens may be asked to vote in the process. Such a licence is valid for two years. The fee he has to pay for it is only NT$200 (about HK$50).

台北市共有60個地區容許街頭藝人表演,包括捷運站外廣場、公園、步行街等,表演者須先申請,經由專業藝術界人士、場地管理單位及街頭藝人代表組成的審議委員會審核,評審時更開放讓民眾參與投票,經批核後牌照有效期兩年,費用只需200元新台幣(約港幣50元)。

There are rules street performers must follow. For example, a street performer must have his licence conspicuously displayed when he performs; he must allow pedestrians a three-metre wide passage; he must not block any building entrance or the access to any fire safety equipment; he must be at a good distance from any other performer; he may only perform between 1000 hours and 2200 hours; and he must clean the place up and put it to rights following his performance. He may be punished if he breaks any of those rules.

表演者演出時有一定規限,包括必須於現場顯著位置展示活動許可證,必須預留3公尺以上行人通行空間,不得阻礙建築物出入口或消防安全設備,又規定不同表演者之間須維持一定距離。表演時間限制在上午10時至晚上10時,表演完畢必須把場地回復原狀,保持地方清潔,違者有可能被處罰。

Hong Kong would do well to learn from Taiwan's experience. The authorities should have no control over what street performers do in their performances. Their business is to maintain public order and ensure public safety. Pedestrian streets in tourist areas are narrow and extremely crowded. However, if there are time and noise restrictions and they are suitable managed, performances that are not action-based (like music playing and acting) will not severely affect shops or pedestrians in those streets. As for variety shows and performances that involve many people, they should take place in parks or other vast places. The authorities can ensure public safety if they do so.

台灣的做法值得香港參考。街頭表演要規管的不是內容,而是公眾安全與秩序,香港的遊客區步行街雖然道路狹窄人流極多,但只要有合適的管理,劃出部分地方予相對靜態的表演,如奏樂、話劇等,並在時間及噪音上設立限制,相信不會對途人及商舖構成太大影響。至於涉及雜耍及多人表演的活動,就應分流至較空曠的公園或廣場,公眾安全就可以兼顧了。

The government should find suitable places for street performances. However, street performers must be cooperative. We do not think citizens will have objections to what the government will do for the sake of the public interest if, though it has tried its best to make arrangements, street performers are so uncooperative that they perform in unsuitable places or in such a way that their performances disturb citizens.

只要政府劃出合適的表演地方,表演者也有責任合作;要是政府已盡力安排,但街頭藝人仍不願配合,強行在不合適的地方及干擾他人的情况下表演,屆時政府為公眾利益而採取行動,相信公眾也不會反對。
